§ 42-110. Penalty for violation of fire prevention code.

  • (a)

    Any person, firm, corporation or agent who shall violate a provision of the fire prevention code, or fail to comply with any of the requirements thereof, or shall erect, install, alter, repair or do work in violation of the approved construction documents or directives of the fire inspector, or of a permit or certificate used under the provisions of the code, shall be guilty of a misdemeanor punishable by a fine of not more than 50 dollars or by imprisonment not exceeding 30 days, or both such fine and imprisonment. Each day a violation continues after due notice has been served shall be deemed a separate offense. Violations of the occupancy limits established pursuant to the International Fire Code shall be a misdemeanor subject to a $100.00 fine for the first offense, a $250.00 fine for the second offense, and a $500.00 fine and up to 30 days imprisonment for a third offense.

    (b)

    The application of the penalty in subsection (a) of this section shall not be held to prevent the enforced removal of prohibited conditions.
